Terms
And Conditions
Please read these terms and conditions before pressing the SUBMIT/ORDER button. Please print them out for your records and safe-keeping. By ordering a web design, logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions. You also accept these terms and conditions if you ask us to transfer your domain, transfer your hosting or ask for any other service request. TERMS OF SERVICE We provide World Wide Web page hosting, Domain Registration and web design (through an outsourced third party). We reserve the right to suspend or cancel a customer's access to any or all services provided by Life Coach Web Solutions when Life Coach Web Solutions decides that the account has been inappropriately used or otherwise as mentioned in the below section - 'server content'. We reserve the right at any time to access, amend, remove or delete any or all data stored on our servers without your prior consent. When your account is closed, all files (including web pages, etc.) will be deleted. We reserve the right to cancel your account at any time without notice. To protect your privacy we never distribute your name or e-mail address to any third parties, unless instructed to do so by order of a Court. COMPLAINTS
Your satisfaction is very important to us so please let us know if you have a problem. SIGN OFF FOR WEB DESIGN Once we have completed your web design we will make it "LIVE" by uploading it to the web. By doing this you are acknowledging that you are happy with everything and the web site becomes your copyright and responsibility. Ownership and it's contents are now yours. SECURITY Purchases online at Life Coach Web Solutions are made through WorldPay - a highly respected leader in the field of ecommerce based in the UK. The security used is Thawte 2048 bit encryption systems. At the browser 128 Bit SSL is used. SERVER USE Personal accounts are to be used by the primary owner only. You must not divulge your username or password to any other person, and you should take reasonable precautions to ensure that other people do not discover it. BACK-UPS We do not backup client data stored on our servers. It is recommended that you keep an independent backup of all data stored on your virtual server. SERVER CONTENT Life Coach Web Solutions do not allow any of the following content to be stored on its servers: Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Life Coach Web Solutions. Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, MP3's , games patches or games orientated material etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. TRANFERRING DOMAINS Yes, you are free to do this although we would be naturally disappointed because a lot of time and effort will have gone into designing and supporting your site for such a low cost. Our prices and effort reflect our committment into helping the new coach but at the end of the day you are free to do what you like. Having said that there are some universal rules with regards to transferring domains: ICANN regulations prohibit transferring a domain name that has been registered or previously transferred within the last 60 days. Our registrar does not allow transfers of domains that are within 10 days of expiration or that have already expired. If your domain name is within 10 days of expiration or has already expired, we recommend that you first renew your domain with us and then transfer it out. When a domain name expires, it enters a 45 day grace period during which it may still be renewed. However, if you renew your domain name during this grace period you may still be prevented from transferring it until the full 45 days have passed. Check with your current registrar regarding their renewal and transfer policies during this grace period. If a domain name is locked at the registry, it is unavailable for transfer. Check with your current registrar to see if your domain is locked. If your domain is already registered here, then it cannot be transferred to us. Some registries restrict the use of profanity in the domain name; this could also restrict a transfer. If your domain is registered as Private it cannot be transferred. BANDWIDTH POLICY Bandwidth is the amount of accrued data transferred between your web site and the sites visitors -1.5GB is more than ample for just about every web site - should you exceed this limit by a small amount every so often you will not incur any penalties. Should your site become a large drain on our resources we do reserve the right to suspend your account until a suitable solution is reached. CANCELLATION AND REFUNDS Life Coach Web Solutions reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of service. If a customer contravenes Life Coach Web Solutions terms of service a refund will not be issued in the event of a cancellation. INDEMNIFICATION The customer agrees that it shall defend, indemnify, save and hold Life Coach Web Solutions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Life Coach Web Solutions , its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Life Coach Web Solutions against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Life Coach Web Solutions servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Life Coach Web Solutions server. RESPONSIBILITY OF WEB DESIGN It is your responsibility to ensure that you provide LCWS with text and timely responses for the completion of your website. Our money-back guarantee is valid for 3 months after the purchase of a web site. So if you start your design and then leave it only to come back 7 months later and request a refund you will not be entitled to one. We have hosting charges and staff costs to bear. You would have been assigned a designer who had worked on the planning and design of your site. COPYRIGHTS You own the copyrights to the website. Whilst designing your site we will do our best endeavours to ensure that all images and pictures are copyright free and will not knowingly use any pictures that are copyrighted from any other source. By ordering a design from us you are agreeing to accept responisbility for any copyright infringes made upon you. We recommend that you provide us with any pictures to use. In the unlikely event that we have used any images in error that are copyrighted by another company you agree to take the matter forward and pay any subscription or fees including any legal costs associated with using them. You hereby agree to defend, indemnify and hold harmless Life Coach Web Solutions against liabilities arising out of any infringements regarding the proprietary rights of a third party or any copyright infringements. You are responsible for the text and images on your website. DOMAIN NAME RENEWAL POLICY Whilst we act in an agency capacity for purchasing domain names it is your responsibility on a yearly basis to renew your domain. We will send you a reminder of when you have to do this before the renewal date so that you can make the arrangements to renew yourself. WEB DESIGN COMPLETION Your web design will be outsourced to a third party - (www.webartindia.com).You hereby agree to defend, indemnify and hold harmless Life Coach Web Solutions against liabilities arising out of any infringements regarding the proprietary rights of a third party or any copyright infringements that are made by Web Art India during their design and completion of your website. In any event where such proprietary or copyright infringements may occur you agree to hold harmless Life Coach Web Solutions as described above and hereby agree to take the matter further with Web Art India. After the website is LIVE you are reminded that it is your responisbility to check and research copyrights and proprietary rights of your content and images whether they have been supplied by a third party or not. You hereby agree that once LIVE the ownership and title of the design and all of it's contents becomes yours. Webart
Internet Services ASSISTANCE We do
try to help people as much as possible, but there is a limit to how
much because of time restrictions. Helping those unfamiliar with the
web is something we like to offer but does not constitute part of
our packages. At times we will not be able to help - such as during
busy periods or perhaps holiday times and occasionally the problem
may be beyond the scope of our knowledge. DISCLAIMER Whilst every care is taken by Life Coach Web Solutions in the provision of our services we can not be responsible for any damages your business may suffer through technical outages or other occurances. This includes loss of data resulting from delays, non-deliveries, DNS transfer delays, wrong delivery, and any and all service interruptions caused by Life Coach Web Solutions , its employees, suppliers, customers or any third party. Life Coach Web Solutions reserves the right to revise its policies at any time. This is all legal stuff - phrased as is to protect ourselves and you - we are very friendly and helpful people really!
